1. Introduction
These Terms & Conditions (“Terms”) apply to all gardening, landscaping, and maintenance services (“Services”) provided by Lucas Gardening Ltd (“Company”, “we”, “us”, “our”) to the client (“you”, “your”). By engaging our services, you agree to these Terms.
2. Services
•We will provide the Services as agreed in your quotation or service agreement.
•Any changes to the scope of work must be agreed in writing.
•We reserve the right to decline work that is unsafe, unlawful, or beyond our expertise.
3. Quotations & Pricing
•All quotations are valid for 14 days from issue.
•Prices are based on the information provided; additional work may incur extra charges.
•Materials will be charged at cost plus a handling fee unless otherwise agreed.
4. Payment
•Payment is due upon completion of the Services, unless otherwise agreed in writing.
•Payments must be made on the day of completion by cash, bank transfer, or agreed method.
•We reserve the right to withhold further work until payment is received.
•Late payments may incur additional charges.
5. Cancellations & Rescheduling
•If you need to cancel or reschedule, please give at least 48 hours’ notice.
•Cancellations with less than 24 hours’ notice may be charged at [e.g. 50%] of the service fee.
•We may cancel or postpone due to severe weather or circumstances beyond our control.
6. Client Responsibilities
•Ensure access to the property on the agreed dates/times.
•Inform us of any hazards (e.g. uneven ground, hidden cables/pipes, dangerous plants, pets).
•Obtain necessary permissions (planning, landlord, council) before work begins.
7. Liability
•We will exercise reasonable skill and care in providing our Services.
•We are not liable for:
•Pre-existing damage to property, plants, or turf.
•Damage caused by hidden obstructions (pipes, cables, roots).
•Weather-related damage after work completion.
•Our liability is limited to the value of the contract.
8. Insurance
•We carry public liability insurance up to £1,000,000.
•Proof of insurance is available upon request.
9. Materials & Waste
•All materials supplied remain our property until paid in full.
•Waste removal will only be included if agreed in writing; otherwise, it is the client’s responsibility.
10. Complaints
•Complaints must be made in writing within 7 days of the service.
•We will aim to resolve complaints promptly and fairly.
11. Governing Law
These Terms are governed by the laws of England & Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England & Wales.
